On Thursday (July 22), Mississippiâs attorney general launched a legal challenge to the US Supreme Courtâs landmark abortion ruling, calling it âegregiously wrong.âÂ
âThe conclusion that abortion is a constitutional right has no basis in text, structure, history, or tradition,â state Attorney General Lynn Fitch wrote in a new legal brief, according to CNN.Â
Fitch added that the case for overturning Roe v. Wade is âoverwhelming.â Fitch along with other state attorneys are appealing lower court rulings that blocked the Gestational Age Act, a law banning most abortions after 15 weeks of pregnancy.
Under the Gestational Age Act, later abortions would only be permitted under medical emergencies or several fetal abnormality, NBC News reported.
Mississippi asked the Supreme Court to take up its challenge to the law last year but the Supreme Court said that the stateâs arguments âdo not require the court to overturn either Roe or Casey,â referring to the two landmark rulings ââ Roe v. Wade which legalized abortion prior to viability nationally and Planned Parenthood v. Casey which upheld the courtâs initial ruling.Â
The justices last year said Mississippiâs attorneys âmerely ask the court to reconcile a conflict in its own precedents.â Now, Fitch is taking a more aggressive approach with the stateâs latest legal challenge to the courtâs landmark decisions.
Oral arguments will most likely begin in late fall or early winter of this year and a decision could be expected next June, according to CNN.
Abortion rights advocates will be watching to see how the conservative majority will decide on this new challenge to legal abortion.
